Court declines request to stop Edo assembly from impeaching Deputy Governor

Edo State Deputy Governor, Philip Shaibu’s request for an order Governor Godwin Obaseki, the House of Assembly and others to maintain the status quo on impeachment proceedings against him, pending determination of a lawsuit he filed, has been declined by a federal high court sitting in Abuja. 

Shaibu’s lawyer, Prof. Oladoyin Awoyale on Wednesday, March 20, moved motions for substituted service of court documents in respect of the case on some of the first to fourth defendants, who he said were yet to be served.

Justice Omotosho however declined the request on the grounds of the plaintiff being unable to effect service on all the listed defendants. He stated that it would be untidy to issue any order against them.

Pointing out that the court’s Easter vacation would commence on Friday, March 22, the Judge advised the lawyer to the plaintiff to apply to the court’s Chief Judge for permission to have the case heard during the vacation. The case was then adjourned till April 15.
